Rule 39; execution; judge sanctioned.

The Court ruled that Judge Balindong clearly ignored the principle of judicial stability by issuing a TRO to temporarily restrain Sheriff Gerard Peter Gaje from enforcing the writ of execution issued by a co-equal court, Branch 6 of the Iligan City RTC, and from pursuing the garnishment of the amount of Php2,726,189.90 from Mindanao State University (MSU)’s account with the Landbank of the Philippines (LBP), Marawi City Branch. The writ of execution was issued by the Iligan City RTC Branch 6 pursuant to its decision in an action for damages arising from a vehicular accident against MSU, holding the latter liable for damages amounting to Php2,726,189.90.
